Former ND oral surgeon wins whistleblower case
FARGO, N.D. (AP) — A Cass County jury has awarded $900,000 to a former MeritCare oral surgeon who sued the Fargo-based health provider for whistleblower retaliation and breach of contract.
Mitchell Magid claimed he was fired in November 2009 because he raised concerns about practices involving a disposable breathing device and because he complained about the work of a fellow surgeon. The Forum newspaper reports that a jury on Tuesday awarded him the damages plus interest. A judge will rule later on his request to be reimbursed for attorney fees.
MeritCare now operates as Sanford Health. Spokesman Darren Huber says Sanford is disappointed in the outcome of the case and will decide soon on an appeal.
Magid currently practices in Lynchburg, Va.
